Awahe Automate Terms of Service
Last updated: November 5, 2026
These Terms cover the Awahe Automate Chrome extension, its practice load board and the Awahe server that sends email for it (together, the "Service"). Awahe Automate is provided by Awahe Inc., 2311 N Tracy Blvd A, wv06, Tracy, CA 95376 ("Awahe", "we"). By installing or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Who can use it
- You must be at least 18 and able to enter a contract.
- Access needs an academy code from Awahe Academy. If you use the Service for a company, you confirm you may act for that company.
- You are responsible for keeping your computer, browser and connected email accounts secure.
2. What the Service is, and isn't
- Awahe Automate is a dispatch helper. It shows RPM, profit estimates, broker checks and route maps for loads you are viewing, and sends broker emails from your own email account when you press Send.
- It only acts when you click. It does not refresh load boards, search for loads or send email on its own.
- Awahe is not a carrier, broker, dispatcher of record, factoring company or insurer, and does not arrange or take part in any load, rate or payment.
- Awahe Automate is not affiliated with, endorsed by or sponsored by DAT Solutions, LLC or any load board. DAT, DAT One and other names belong to their owners and are used only to describe compatibility.
3. Your load board account
You need your own valid subscription to any load board you use the Service with, and you must follow that load board's terms. Do not use the Service to copy, collect or resell load board data, to share your login, or to get around any limit a load board sets. We may change how the Service works on a load board, or stop supporting one, at any time.
4. Your email and messages
- You choose which email account to connect and authorize. You can remove it at any time in Settings.
- You are responsible for every message you send, including its content and recipients, and for following the law (including the CAN-SPAM Act) and your email provider's rules.
- Don't send spam, bulk unsolicited email, false or misleading information, or anything unlawful. We set a daily sending limit and may lower it or suspend sending to protect email deliverability or stop abuse.
5. Estimates and broker information
RPM, fuel, driver pay and profit figures are estimates based on the numbers you enter and the load details shown. Broker checks use public FMCSA data, which may be out of date or incomplete. Always verify a broker's authority, insurance and payment history yourself before booking. Nothing in the Service is legal, tax, financial or insurance advice.
6. Acceptable use
Don't misuse the Service. That includes: breaking the law or anyone's rights; trying to access other users' data or our server without permission; probing, overloading or attacking the Service; reverse engineering, copying or reselling it; or using it to build a competing product.
7. Access, fees and changes
The Service is provided to Awahe Academy students. Any fees are set out in your Awahe Academy enrollment, not in these Terms. We may add, change or remove features, and may suspend or end your access if you break these Terms, your academy access ends, or we stop offering the Service. You can stop using it at any time by uninstalling the extension and removing your connected email accounts.
8. Ownership
Awahe owns the Service, including its software, design, templates and the Awahe name and logo. You keep ownership of your own content, such as your templates, signature and messages, and let us process it only to run the Service.
9. No warranty
The Service is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We don't promise it will be error-free, always available, work with every load board change, or produce any business result.
10. Limit of liability
To the fullest extent the law allows, Awahe is not liable for lost profits, lost loads, lost data or any indirect, incidental or consequential damages, or for the actions of load boards, brokers, email providers or other third parties. Our total liability for any claim about the Service is limited to the greater of the amount you paid Awahe specifically for the Service in the 6 months before the claim, or $100.
11. Indemnity
You agree to cover Awahe's losses and reasonable legal costs from claims caused by the emails you send, your breach of these Terms, or your violation of law or a load board's terms.
12. Governing law and disputes
California law governs these Terms. Before filing any claim, contact us at sales@awahe.com so we can try to resolve it informally within 30 days. If we can't, the state and federal courts located in San Joaquin County, California will have exclusive jurisdiction.
13. Changes to these Terms
We may update these Terms. We will show material changes inside the extension before they take effect and update the date above. Continuing to use the Service after that means you accept the updated Terms.
14. Other terms
If part of these Terms can't be enforced, the rest still applies. These Terms and the Privacy Policy are the whole agreement about the Service. We may transfer them as part of a merger, acquisition or sale of assets.
