1. Definitions and Interpretation

These Terms and Conditions apply to the use of the Awahe website (awahe.com and its subdomains) and the Awahe mobile application (collectively referred to as the "Platform").

This Agreement is between you ("User") and Awahe ("Company", "we", "us", or "our"), a company incorporated in California, USA, with its registered address at 2311 N TRACY BLVD, WV 06, TRACY, CA 95376, USA. This Agreement governs your use of our website (awahe.com), mobile applications, and all related services (collectively, the "Services").

By downloading, accessing, or using any part of the Services, you agree to be bound by these Terms and Conditions. If you do not agree, you must discontinue use of the Services immediately.

You must be at least 13 years of age to use the Services. If you are under 18, you may only use the Services under the supervision of a parent or legal guardian. Certain features, including purchases and enrollment in paid courses, require you to be at least 18 years of age or to have parental or legal guardian authorization.

The mobile application is licensed, not sold, to you, and your use of the Services is subject to this Agreement. We may update these Terms from time to time. Where required, we will notify you of material changes via email or in-app notification. Continued use of the Services after such updates constitutes your acceptance of the revised Terms.

You acknowledge that you have read, understood, and agree to be legally bound by this Agreement.

In this Agreement, unless the context otherwise requires, the following terms shall have the meanings set out below:
"Account" means the registered account created by a User to access and use the Services, including associated credentials, profile information, and activity data.
"Application" means the Awahe mobile application, including all features, functionalities, updates, upgrades, and related services made available on supported mobile devices.
"Website" means the website located at awahe.com and any associated subdomains, unless expressly excluded by their own terms and conditions.
"Content" means all materials available through the Services, including but not limited to text, graphics, images, audio, video, course materials, software, and data, whether owned by Awahe or licensed from third parties, as well as any content submitted or uploaded by Users.
"Device" means any mobile phone, tablet, or other supported hardware used to access the Application.
"Facilities" means any online tools, features, or resources made available by Awahe as part of the Services, whether now or in the future.
"Intellectual Property" means all intellectual property rights, including but not limited to patents, copyrights, trademarks, trade secrets, course materials, and other proprietary rights owned by or licensed to Awahe.
"Payment Information" means any billing or payment details provided by the User in connection with purchases made through the Services, which may be processed securely by third-party payment providers or platform billing systems.
"Premises" means Awahe’s place(s) of business located at 2311 N TRACY BLVD, WV 06, TRACY, CA 95376, USA.
"Services" Means collectively any online facilities, tools, services or information that Awahe inc makes available through the Platform either now or in the future;
"Subscription" means any recurring paid plan that provides access to certain Services for a specified billing period and may automatically renew unless cancelled in accordance with these Terms.
"System" Means any online communications infrastructure that Awahe inc makes available through the Platform, either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities, and email links.
"Platform" 
Means collectively the Awahe website (awahe.com) and the Awahe mobile application, including all versions, updates, and related software.
"Third-Party Services" means any external services, platforms, or integrations accessible through the Services that are not owned or controlled by Awahe.
"User" or "Users" means any individual who accesses or uses the Services, whether registered or not.
"We", "Us", or "Our" means Awahe, a company incorporated in California, USA, with its registered address at 2311 N TRACY BLVD, WV 06, TRACY, CA 95376, USA
"Profile" means the public-facing account page of a registered User of the Platform, including their display name, profile photo, cover photo, bio text, and interest tags, as configured by the User through the Application or Website.

2. Age Restrictions

You must be at least 13 years of age to use the Services. Awahe utilizes the Apple Declared Age Range API and Google Play New Play API to verify age categories.
Minors (Under 18): If you are under 18, you may only use the Services with Verifiable Parental Consent (VPC). This consent must be provided through a linked parental account or a commercially recognized verification method (e.g., credit card authentication).
Parental Revocation: Parents or legal guardians have the right to revoke consent at any time. Upon revocation, access to the Services will be immediately terminated.  

Data Treatment: All information collected from users under the age of 16 is treated as Sensitive Personal Information (SPI) under California law.
Awahe does not knowingly collect personal information from children under the age of 13. If we become aware that a User is under 13, we reserve the right to suspend or terminate the Account and delete associated data in accordance with applicable laws. If you believe that a child under 13 has provided personal information, please contact us at info@awahe.com.

3. Business Customers

These Terms and Conditions apply to all Users who access or use the Services, including individuals acting on behalf of a business, organization, or other legal entity.
If you use the Services on behalf of a business or other legal entity, you represent and warrant that:
  • You have full legal authority to bind that entity to these Terms;
  • The entity agrees to be fully responsible for all use of the Services under its Account; and
  • References to “User” in this Agreement shall include both you as an individual and the relevant entity.

These Terms apply equally to business customers who procure or use the Services in the course of their commercial operations.

4. Intellectual Property

All Content available through the Services—including the Website, Application, and any related platforms—such as text, graphics, logos, icons, images, audio, video, course materials, software, underlying code, data compilations, and page layouts, is the property of Awahe, its affiliates, licensors, or other relevant third parties. By using the Services, you acknowledge that such Content is protected by applicable United States and international intellectual property laws.

All rights, title, and interest in and to the Content remain exclusively with Awahe or its licensors. No ownership rights are transferred to you through your use of the Services.
Except as expressly permitted by these Terms or with Awahe’s prior written consent, you may not:
  • Copy, reproduce, modify, or create derivative works from any Content;
  • Distribute, transmit, display, publish, or otherwise make available any Content;
  • Record, download, reproduce, or share course materials in any format;
  • Store, archive, or re-use any Content for commercial or non-personal purposes;
  • Resell, sublicense, or commercially exploit any part of the Services or its Content.

Any unauthorized use of the Content may result in the suspension or termination of your Account and may subject you to civil and/or criminal liability under applicable laws.
Mobile App License: Subject to your compliance with these Terms, Awahe inc grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the mobile application for your personal, non-commercial use on a single mobile device owned or otherwise controlled by you.

5. Third Party Intellectual Property

Certain Content made available through the Services may be owned by third parties, including licensors, partners, or other rights holders, and is used by Awahe under license or with permission. Unless otherwise indicated, all intellectual property rights in such third-party Content—including but not limited to copyrights, trademarks, product images, and descriptions—remain the exclusive property of their respective owners and are protected by applicable United States and international intellectual property laws.
Awahe does not grant you any rights or licenses to third-party intellectual property beyond those strictly necessary for your personal, non-commercial use of the Services in accordance with these Terms.
Without the prior written permission of the applicable rights holder, you may not:
  • Copy, reproduce, modify, or create derivative works from third-party Content;
  • Distribute, publish, transmit, display, or store such Content in any format;
  • Use such Content for any commercial purpose;
  • Re-use such Content in any manner not expressly permitted by these Terms.

Any permitted use of third-party Content remains subject to the terms and conditions imposed by the respective rights holders. Awahe shall not be liable for any unauthorized use of such Content by you.

6. Fair Use and Limited Use of Content

Users may access and use Content through the Services solely for personal, non-commercial purposes and in accordance with these Terms. Nothing in these Terms shall be construed as granting any license or right to use any Content beyond what is expressly provided.
Except as permitted under these Terms or applicable law, no part of the Content may be copied, reproduced, distributed, modified, or used for any commercial purpose without the prior written consent of Awahe or the applicable rights holder.
Where permitted by applicable law—including fair use provisions under United States copyright law—Content may be referenced or cited in limited form without prior written permission, provided that such use:
  • Is non-commercial in nature;
  • Does not adversely affect the value or integrity of the original Content; and
  • Includes appropriate attribution to Awahe or the relevant rights holder.

7. Third-Party Links and Services

The Services may contain links to third-party websites, services, or resources that are not owned or controlled by Awahe. Awahe does not control and is not responsible for the content, privacy policies, or practices of any third-party websites or services. The inclusion of such links does not imply any endorsement or approval by Awahe.
You acknowledge and agree that Awahe shall not be liable for any loss or damage arising from your use of, or reliance on, any third-party content, products, or services accessed through the Services.
You may link to our Website homepage at awahe.com without prior written permission, provided that such linking is fair, lawful, and does not damage our reputation or imply any form of association, approval, or endorsement by Awahe where none exists. Deep linking to specific pages within the Website requires Awahe’s prior written consent. To request permission, please contact us at info@awahe.com.

8. Use of Communications Facilities

When using any System within the Services, you agree to comply with the following rules. Failure to do so may result in the suspension or termination of your Account:
  • You must not use obscene, offensive, or vulgar language;
  • You must not submit Content that is unlawful or otherwise objectionable, including but not limited to Content that is abusive, threatening, harassing, defamatory, discriminatory, or harmful;
  • You must not submit Content that promotes or incites violence;
  • You must not impersonate any individual or entity, including employees or representatives of Awahe;
  • You must not use false or misleading identification information;
  • You must not use the System for unauthorized or unsolicited communications, including spam or junk messages;
  • You acknowledge that certain communications may need to be in English for effective support and response.

You further acknowledge and agree that:
  • Awahe reserves the right (but not the obligation) to monitor communications made through the System;
  • Awahe may retain copies of communications for operational, legal, or support purposes;
  • By submitting Content through the System, you grant Awahe a non-exclusive, worldwide, royalty-free license to use, reproduce, and process such Content for the purpose of operating and improving the Services;
  • Awahe reserves the right to remove or modify any Content that violates these Terms or applicable laws.

9. Accounts

To access certain features of the Services, you may be required to create an Account and provide certain personal information. Payment Information may only be required when you make a purchase.
By creating an Account and using the Services, you represent and warrant that:
  • All information you provide is accurate, complete, and up to date;
  • You have the necessary authorization to provide any Payment Information;
  • You will maintain and promptly update your Account information as needed.
You are solely responsible for maintaining the confidentiality of your Account credentials, including your username and password, and for all activities conducted under your Account. You must not share your Account details with any third party. Awahe shall not be liable for any loss or damage arising from your failure to safeguard your Account credentials.
If you access the Services on a shared or public device, you are responsible for ensuring that your Account credentials are not stored or accessible to others.
If you believe that your Account has been accessed without authorization, you must notify us immediately at info@awahe.com. We will take reasonable steps to secure your Account; however, we are not responsible for any losses incurred prior to such notification.
You may be responsible for charges incurred through your Account prior to notifying us of unauthorized access, to the extent permitted by applicable law.
When selecting a username or profile name, you must comply with the rules set out in Clause 8 of these Terms. Failure to do so may result in the suspension or termination of your Account.

10. Termination and Cancellation of Accounts

You may terminate your Account at any time by discontinuing use of the Services or by contacting us.
Awahe may suspend or terminate your Account at any time, including where:
  • You violate these Terms;
  • You engage in fraudulent, abusive, or unlawful activity; or
  • Your use of the Services may harm Awahe, other users, or third parties.
Where reasonably practicable, we will notify you of such suspension or termination and provide an explanation.
Upon termination of your Account for any reason, your right to access and use the Services will cease immediately.
If your Account is terminated:
  • Any active subscriptions or Services may be discontinued;
  • You may be responsible for charges incurred up to the effective date of termination, to the extent permitted by applicable law.
Any Content or data associated with your Account may be retained or deleted in accordance with our Privacy Policy and applicable legal requirements. Where you request permanent account deletion, we will process and complete the deletion of your personal data within 30 days of receiving a valid deletion request, except where retention is required by applicable law. You may submit a deletion request through the Awahe mobile app under Account Settings, by visiting awahe.com/delete-account, or by emailing info@awahe.com with the subject line "Data Deletion Request." You will receive confirmation by email once deletion is complete.

11. Services, Pricing and Availability

Awahe makes reasonable efforts to ensure that all descriptions of Services available through the Website and Application are accurate. However, the nature and delivery of the Services may vary based on individual circumstances, user requirements, or updates to the Services.

Awahe
does not guarantee that all descriptions, features, or content are always complete, current, or error-free, but will take reasonable steps to correct any inaccuracies where identified.

Where applicable, you may be required to select a specific plan, package, or Subscription prior to purchasing or accessing certain Services.
Awahe does not guarantee that the Services will be available at all times or without interruption. Availability of Services may be subject to change without notice.

All pricing information displayed through the Services is accurate at the time of publication. Awahe reserves the right to change prices, modify plans, or withdraw promotional offers at any time, to the extent permitted by applicable law.
Where a purchase is made, the price charged will be the price presented to you at the time of checkout or order confirmation.

Course category cards displayed on the Platform provide summary information only. Full course details, pricing, and enrollment options are available on individual course pages. Clicking a course category card does not constitute enrollment or any binding commitment.

12. App Store Specific Provisions

Nothing within the Services—including the Website or Application—constitutes a binding contractual offer. Any order placed by you constitutes an offer to purchase Services, which Awahe may accept or reject at its sole discretion. A binding contract is formed only when we confirm acceptance of your order, typically by sending an order confirmation via email or through the Services.
Order confirmations will include relevant details of the Services, which may include:
  • A description of the Services purchased;
  • Applicable pricing and charges;
  • Access details or instructions for use of the Services, where applicable.
If you believe that any Services provided do not conform to your order, you should contact us promptly at info@awahe.com. We will review the issue and take appropriate steps in accordance with applicable policies and laws.If Awahe does not accept your order, no contract will be formed. Where payment has already been processed, any applicable refund will be issued in accordance with our refund or cancellation policies and applicable law.
Payment for Services may be processed at the time of purchase and, where applicable, on a recurring basis for Subscriptions, as disclosed at the time of checkout.
Awahe will use reasonable efforts to provide the Services within a reasonable timeframe. However, all timeframes are estimates only and may be subject to change due to operational or technical factors.
Awahe will provide the Services with reasonable skill and care, consistent with generally accepted industry standards.
Additional terms and conditions may apply to specific Services, and you may be required to accept such terms at the time of purchase or use.
Awahe may provide customer support through available channels, but we do not guarantee response times or availability of support services.
12.1 Third-Party Terms: You acknowledge and agree that the availability of the mobile application is dependent on the third party from whom you received the application license, e.g., the Apple App Store or Google Play (“App Store”).
12.2 Maintenance and Support: Awahe inc is solely responsible for providing any maintenance and support services with respect to the mobile application. You acknowledge that the App Store has no obligation whatsoever to furnish any maintenance and support services.
12.3 Device Requirements: To use the mobile application, you must have a compatible mobile device. Awahe inc does not warrant that the application will be compatible with your mobile device.

13. Cancellation of Orders and Refund Policy

Awahe aims to provide high-quality Services and wants you to have a positive experience. If you have any questions regarding your order, you may contact us at info@awahe.com or at our registered address.
You may cancel an order in accordance with this clause. Where specific Services include additional cancellation terms, those terms will apply.

13.1 Digital Services and General Policy

Due to the nature of digital products and online Services, certain purchases may be non-refundable once access has been granted or Services have commenced.
Unless otherwise required by applicable law or stated otherwise:
  • Refunds will generally not be provided once access to digital content, training materials, or platforms has been granted;
  • Refunds will not be issued where Services have been delivered as described;
  • Missed sessions, lack of participation, scheduling conflicts, or changes in personal circumstances do not typically qualify for refunds.

Refund requests may be reviewed on a case-by-case basis at Awahe’s discretion. Approved refunds, where applicable, will be processed through the original payment method, subject to payment provider timelines.
For purchases made through third-party platforms (such as mobile app stores), refunds may be subject to the respective platform’s billing and refund policies.

13.2 European Union Customers
If you are a consumer located in the European Union, you may have a statutory right to cancel your purchase within 14 days of confirmation (the “cooling-off period”), unless an exception applies.
If you request that Services begin during the cooling-off period:
  • You acknowledge that your right to cancel may be reduced or lost once the Services have been fully performed;
  • If you cancel after Services have begun, you may be required to pay for the portion of Services already provided, in accordance with applicable law.


13.3 Service Delivery Issues
If Awahe is unable to provide the Services as agreed, you may be eligible for a refund or other appropriate remedy in accordance with applicable laws.

13.4 Payment Method Clarification

Awahe Inc. does not process any payments through the Apple App Store or Google Play Store in-app billing systems. All purchases, course enrollments, and subscription plans are handled exclusively through:

- The Awahe website at awahe.com
- Direct payment methods as presented at checkout on the Website

The Application itself is free to download. No in-app purchases, in-app subscriptions, or digital goods are sold through the Application via Apple or Google billing systems.

14. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
The Privacy Policy explains how we collect, use, store, and protect your personal information. By using the Services, you acknowledge that you have read and understood our Privacy Policy.
You may review our Privacy Policy at awahe.com/privacy or access it within the Application settings or through the relevant app store listing.

15. Data Protection and User Rights

We process personal information in compliance with the CCPA/CPRA.
Expanded Access: Users have the right to request access to all personal information collected by Awahe since January 1, 2022, regardless of the 12-month period.  
Sensitive Data: We do not collect "Neural Data" (information generated by the central or peripheral nervous system). If such data were ever collected, it would be treated as Sensitive Personal Information (SPI) requiring explicit opt-in.
Opt-Out Preference Signals: We honor browser-based opt-out signals (such as Global Privacy Control) as valid requests to opt-out of the sale or sharing of personal information.

We may share your personal information, where necessary, with:
  • Payment processors and financial service providers to facilitate transactions;
  • Third-party service providers that support the operation of the Services, such as hosting, analytics, communication, or customer support tools;
  • Legal or regulatory authorities where required to comply with applicable laws or legal obligations.
All third parties are required to process your personal information in accordance with applicable data protection laws and are subject to appropriate confidentiality and data protection obligations.
We do not sell or rent your personal information to third parties. We will not disclose your personal information to any other parties without your consent, except where required or permitted by law.

16. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Awahe makes no warranties or representations that the Services will meet your specific requirements, be uninterrupted, error-free, secure, or compatible with all devices or systems.
All information and Content provided through the Services is made available in good faith; however, Awahe does not warrant or guarantee its accuracy, completeness, or suitability for any particular purpose. Your use of the Services and reliance on any Content is at your own risk.
The Services are intended for educational and informational purposes only. Nothing within the Services constitutes professional advice, including but not limited to legal, financial, tax, or compliance advice. You are solely responsible for any decisions or actions taken based on the Content.
Nothing in the Services constitutes a binding contractual offer. All orders and agreements are subject to acceptance by Awahe in accordance with Clause 12 of these Terms.
While Awahe takes reasonable measures to maintain the security and functionality of the Services, we do not guarantee that the Services will be free from errors, viruses, or other harmful components. You are responsible for implementing appropriate safeguards to protect your device, data, and personal information.
To the extent permitted by law, Awahe shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.

16b. Automated Decision-Making Technology (ADMT)

Awahe may use AI and automated systems to provide personalized course recommendations and learning assessments.

Pre-use Notice: Before using any system that substantially replaces human decision-making, we will provide a notice explaining the logic involved and the potential outcome.

Right to Opt-Out: You have the right to opt-out of significant automated decisions. If you opt-out, a human reviewer will be assigned to evaluate your progress or request.  

Right to Access Logic: You may request a plain-language explanation of how an automated decision was reached.

17. Changes to the Services and These Terms

Awahe reserves the right to modify, update, suspend, or discontinue any part of the Services or their Content at any time, to the extent permitted by applicable law.
We may also update or revise these Terms from time to time. Where changes are material, we will make reasonable efforts to notify you in advance, including by email or through in-app notifications.
Your continued use of the Services after any updates become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Services and may request closure of your Account by contacting us at info@awahe.com.
Where changes to these Terms are required by applicable law or regulatory requirements, such changes may take effect immediately or as required, and may apply to your continued use of the Services.
17b. Significant Change Notifications
In accordance with the App Store Accountability Act of 2026, any material modification to these Terms that changes data collection categories, alters the app's age rating, or adds new monetization features is considered a "Significant Change."  

For minor accounts, we will notify the holder of the affiliated parental account and obtain new verifiable parental consent before the changes apply to that account.

18. Availability of the Services

The Services are provided on an “as is” and “as available” basis. Awahe uses commercially reasonable efforts and industry-standard practices, including cloud-based infrastructure, to maintain the availability and performance of the Services. However, we do not guarantee that the Services will be uninterrupted, error-free, or continuously available at all times.
To the fullest extent permitted by applicable law, Awahe disclaims all warranties, whether express or implied, including but not limited to warranties of fitness for a particular purpose, accuracy, reliability, availability, or compatibility.
Temporary interruptions, delays, or limitations in availability may occur from time to time. Where required by applicable law, or where Services are materially affected, appropriate remedies may be provided in accordance with our policies.
Awahe shall not be liable for any failure or delay in the availability of the Services resulting from causes beyond our reasonable control, including but not limited to:
  • Internet service provider failures or hosting outages;
  • Telecommunications or network infrastructure disruptions;
  • Power outages or utility failures;
  • Natural disasters, acts of war, terrorism, or civil unrest;
  • Government actions, legal restrictions, or regulatory changes.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Awahe shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of, or inability to use, the Services.
Nothing in these Terms shall exclude or limit Awahe’s liability where it would be unlawful to do so, including liability for:
  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation;
  • Any other liability that cannot be excluded or limited under applicable law.
To the extent permitted by law, Awahe’s total aggregate liability for any claims arising out of or relating to the Services shall be limited to the amount you have paid to Awahe for the specific Service giving rise to the claim.
You acknowledge that your use of the Services is at your own risk.
If any provision of this clause is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

20. No Waiver

Failure or delay by Awahe in exercising any right, power, or remedy under these Terms shall not constitute a waiver of that right, power, or remedy, nor shall it prevent Awahe from exercising it at any future time.

21. Previous Terms and Conditions

In the event of any conflict between these Terms and any prior versions, the current version shall prevail unless expressly stated otherwise.
The most recent version of these Terms will always be available at awahe.com/terms and within the Application and website.

22. Third-Party Rights and Services

Nothing in these Terms is intended to confer any rights upon any third party, and no third party shall have the right to enforce any provision of these Terms.
This Agreement is made solely between you and Awahe.
The Services may include integrations with, or links to, third-party platforms, tools, or services. Awahe does not control and is not responsible for the content, availability, or practices of any third-party services.
Your use of third-party services is at your own risk and subject to the terms and conditions and privacy policies of those third parties.

23. Communications

All formal notices and communications to Awahe must be sent either by post to our Premises at 2311 N TRACY BLVD, WV 06, TRACY, CA 95376, USA or by email to info@awahe.com.
Notices will be deemed received:
  • By post: three (3) business days after the date of posting;
  • By email: on the day of receipt if received during normal business hours, or on the next business day if received outside such hours.

Awahe may send you service-related or promotional communications where permitted by law. You may opt out of marketing communications at any time by using the unsubscribe link in any email or by contacting us at info@awahe.com.

24. Mobile Application License

The Awahe mobile application is licensed, not sold, to you. Subject to your compliance with these Terms, Awahe grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Application for personal, non-commercial purposes.
This license does not grant you any ownership rights in the Application or its underlying software, source code, or intellectual property.
Awahe reserves the right to suspend or revoke this license if you violate these Terms.
We do not guarantee that the Application will be compatible with all devices, operating systems, or third-party software. You are responsible for ensuring that your device meets the necessary requirements for use.

Awahe Inc. may, from time to time, issue updates, patches, or new versions of the Application. Depending on the nature of the update, you may be required to download and install the latest version before continuing to use the Application. Updates may be delivered automatically through the Apple App Store or Google Play Store, or may require manual installation.

Awahe Inc. reserves the right to modify, suspend, or discontinue the Application or remove it from the Apple App Store or Google Play Store at any time, with or without prior notice. In the event of discontinuation, your license to use the Application will automatically terminate, and you should uninstall the Application from your device.

Awahe Inc. shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Application or any part thereof.

25. Payments and Subscriptions

The Awahe mobile Application is free to download and does not offer any in-app purchases or payments through the Apple App Store or Google Play Store billing systems. All payments for Services are processed exclusively through the Awahe website (awahe.com).

Certain Services may be offered as one-time purchases or as subscription-based plans. All purchases and subscriptions are managed directly through the Awahe website (awahe.com).

Subscriptions will automatically renew at the end of each billing period unless cancelled prior to the renewal date. To cancel a subscription, please log in to your account at awahe.com or contact us at info@awahe.com.

For purchases made directly through the Website, payments are processed securely via third-party payment providers. All prices are displayed in USD unless otherwise stated.

26. Law and Jurisdiction

These Terms and Conditions, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.
You and Awahe agree that the state and federal courts located in San Joaquin County, California, USA shall have exclusive jurisdiction to resolve any disputes arising out of or relating to these Terms or your use of the Services.
If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with all applicable local laws and regulations in your jurisdiction. Awahe makes no representation that the Services are appropriate or available for use in all locations.

27. App Store Distribution — Apple and Google Required Notices

27.1 Apple App Store
The following terms apply when you download or use the Application from the Apple App Store:

These Terms and Conditions are concluded between you and Awahe Inc. only, and not with Apple Inc. ("Apple"). Apple is not a party to these Terms and Conditions and is not responsible for the Application or its content.
The license granted to you for the Application is limited to a non-transferable license to use the Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application. Awahe Inc. is solely responsible for providing any maintenance and support services as required under applicable law.
In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Awahe Inc.
Awahe Inc., not Apple, is responsible for addressing any claims you or any third party may have relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the Application or your possession and use of the Application infringes a third party's intellectual property rights, Awahe Inc., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the Application (e.g. your wireless data service agreement).
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and Conditions. Upon your acceptance of these Terms and Conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms and Conditions against you as a third-party beneficiary thereof.
27.2 Google Play Store
The following terms apply when you download or use the Application from the Google Play Store:

These Terms and Conditions are concluded between you and Awahe Inc. only, and not with Google LLC ("Google"). Google is not a party to these Terms and Conditions and bears no responsibility or liability for the Application or its content.
Your use of the Application must comply with Google's then-current Google Play Terms of Service.
Google is only the provider of the Google Play Store, where you obtained the Application. Awahe Inc. is solely responsible for the Application, its content, maintenance, support, and any claims relating to your use of the Application.
27.3 Google Play Families Policy Compliance

The Application complies with Google Play's Families Policy where applicable. Where the Application is made available to users under the age of 13, Awahe Inc. ensures that:

- No interest-based advertising is served to users identified as children;
- No data is collected from child users beyond what is necessary to operate the Application;
- All third-party SDKs and APIs integrated into the Application comply with Google Play's Families Policy requirements;
- The Application does not include any social features that allow children to interact with unknown users without parental oversight.

28. Third-Party Account Sign-In

The Platform allows you to register and log in using third-party social authentication providers, including:
Google (Google LLC)
Facebook (Meta Platforms, Inc.)
LinkedIn (LinkedIn Corporation)
Apple (Apple Inc.)
X / Twitter (X Corp.)
By choosing to sign in using a third-party account, you authorize Awahe Inc. to access and use certain information from that account — such as your name, email address, and profile picture — as permitted by your privacy settings on that platform and in accordance with our Privacy Policy.

Your use of third-party sign-in features is also governed by the respective terms of service and privacy policies of those providers. Awahe Inc. is not responsible for the data practices of these third-party providers.

You may disconnect a third-party account from your Awahe account at any time through your Account settings or by contacting us at info@awahe.com.

29. User Content and Profile Media

29.1 Profile Photos and Cover Images
You may upload profile photos and cover images to personalize your account on the Awahe Platform and mobile Application. By uploading any image or media content, you confirm that:

  • You own the image or have permission to use it
  • The image does not infringe any third party's copyright, trademark, or intellectual property rights
  • The image does not contain nudity, offensive content, or material that violates our community standards
  • You are not uploading images of other individuals without their consent

29.2 License to Awahe
By uploading any image or media content to the Platform, you grant Awahe Inc. a non-exclusive, worldwide, royalty-free license to display and use that content solely for the purpose of operating and improving the Platform and Application. We will not sell your images to third parties.
29.3 Content We May Remove
Awahe Inc. reserves the right to remove any uploaded content at any time without notice if it violates these Terms, our community standards, or applicable law.
29.4 Interest Tags and Bio Content
Content you add to your profile bio and interest tags is visible to other users of the Platform. You are solely responsible for ensuring your bio and profile content is accurate, appropriate, and does not violate the rights of any third party.
29.5 Data Retention
Profile photos and cover images you upload will be retained for as long as your account remains active. Upon account deletion, all uploaded media will be permanently removed within 30 days in accordance with our Privacy Policy.
29.6 No Live Camera Access
The current version of the Awahe mobile Application accesses your device photo library only for profile and cover photo uploads. The Application does not access your device camera directly. You will be prompted to select an existing image from your photo library when uploading profile media.

30. User Profile and Account Settings

30.1 Profile Information
You are responsible for maintaining accurate and up-to-date profile information. Your display name, profile photo, cover photo, bio, and interest tags are visible to other users of the Platform. You must not impersonate any person or entity or misrepresent your identity in your profile.
30.2 Profile Photo and Cover Photo
By uploading a profile photo or cover photo, you confirm that:

  • You own the image or have full permission to use it
  • The image does not infringe any third-party copyright or intellectual property rights
  • The image does not contain nudity, offensive content, or material that violates applicable law
  • You are not uploading images of other individuals without their explicit consent

30.3 Bio Content
Your profile bio is limited to 300 characters and is publicly visible. You must not include in your bio any content that is defamatory, harassing, discriminatory, misleading, or in violation of any applicable law or these Terms.
30.4 Interest Tags
You may select up to 9 interest tags to personalize your profile and improve your networking experience on the Platform. These tags are visible to other users.
30.5 Dark Mode
The Application offers a dark mode display option which is stored locally on your device. This is a display preference only and does not affect your account or data in any way.
30.6 Password Security
You are responsible for maintaining the confidentiality of your account password. You must notify us immediately at info@awahe.com if you suspect any unauthorized access to your account. Awahe Inc. will not be liable for any loss resulting from unauthorized use of your account due to your failure to keep your password secure.
30.7 Rate Us
The Application may prompt you to rate your experience through the official Apple App Store or Google Play Store review system. Ratings and reviews submitted through this feature are governed by the respective store's terms and policies.
30.8 Logout
You may log out of your account at any time through the Profile settings screen. Logging out does not delete your account or personal data. To permanently delete your account, see Section 10 of these Terms or visit awahe.com/delete-account.
30.9 Account Termination by Awahe
Awahe Inc. reserves the right to suspend or terminate your account at any time if you violate these Terms, without prior notice and without liability to you.

31. In-App Messaging and Community Guidelines

31.1 The Awahe Platform includes in-app messaging features allowing Users to communicate with other Users, instructors, businesses listed in the Discover section, and Awahe support staff.

31.2 By using the messaging features you agree not to send messages that are abusive, threatening, harassing, discriminatory, sexually explicit, or otherwise in violation of applicable law or these Terms.

31.3 Awahe Inc. reserves the right to monitor, review, and remove messages that violate these Terms and to suspend or terminate accounts of Users who misuse the messaging features.

31.4 Users may block other Users at any time through the messaging interface. Users may report inappropriate messages using the report function available within the Application.

31.5 Awahe Inc. is not responsible for the content of messages sent between Users but will take reasonable action upon receiving reports of policy violations.

31.6 Message content, timestamps, and user identifiers may be stored securely in accordance with our Privacy Policy. Messages may be retained for operational, legal, or safety purposes as described in our Privacy Policy.

32. Discover Business Listings

32.1 The Awahe Application includes a Discover feature that allows Users to browse and connect with businesses across categories including Trucking, Real Estate, and Food. Business listings are submitted by third parties and are not owned or operated by Awahe Inc.

32.2 Awahe Inc. does not verify, endorse, or guarantee the accuracy, quality, or legitimacy of any business listing displayed in the Discover section. Users are solely responsible for independently verifying the credentials and suitability of any business they choose to engage with through the Platform.

32.3 Awahe Inc. reserves the right to approve, reject, or remove any business listing at any time, without notice, if it is found to violate these Terms, applicable law, or our community standards.

32.4 All businesses currently listed in the Discover section of the Application have provided written authorization to Awahe Inc. to display their business information on the Platform. By submitting a business listing, the business owner or authorized representative confirms that they have full authority to authorize such listing and that all information provided is accurate, current, and compliant with applicable laws and regulations. Businesses may request removal of their listing at any time by contacting info@awahe.com with the subject line "Listing Removal Request." Awahe Inc. will process valid removal requests within 7 business days.

32.5 Awahe Inc. shall not be liable for any loss, damage, or dispute arising from a User's interaction with any business found through the Discover feature.

33. Service Enquiry and Lead Forms

33.1 The Awahe Application includes service enquiry forms through which Users may submit their contact details and service requirements to express interest in services such as factoring, fuel cards, business websites, and trucking business support.

33.2 By submitting a service enquiry form, you consent to Awahe Inc. and relevant third-party service partners contacting you using the contact details provided, including by phone call, email, or text message, in accordance with your stated contact preferences.

33.3 Submission of an enquiry form does not constitute a binding contract or guarantee of service delivery. It is an expression of interest only. A separate agreement will be required before any service is provided.

33.4 Awahe Inc. will share your enquiry details only with relevant service partners required to respond to your request, in accordance with our Privacy Policy.

33.5 You may withdraw your consent to be contacted at any time by emailing info@awahe.com.

34. Device Permissions and Photo Library Access

34.1 The Awahe mobile Application may request access to certain features or data on your device in order to provide specific functionality. The permissions we may request include:


Photo Library — to allow you to select and upload profile photos and cover images from your device. Access is requested only when you initiate a photo upload and is not used for any other purpose.
Push Notifications — to send you service updates, course alerts, and, where permitted, promotional communications. You may disable push notifications at any time through your device settings.
Internet Access — required for all core Application functionality, including course access, account management, and service features.

34.2 The current version of the Application does not access your device camera directly. You will be prompted to select an existing image from your photo library when uploading profile media.

34.3 You may manage all device permissions granted to the Application at any time through your device operating system settings. Revoking a permission may limit or disable certain features of the Application but will not affect your ability to use features that do not require that permission.

34.4 Awahe Inc. will not access any device permissions beyond those listed above without first requesting your explicit consent through a clear in-app permission request.

34.5 Tracking and Advertising Transparency (Apple ATT Compliance)
In accordance with Apple's App Tracking Transparency (ATT) framework, the Application will request your permission before tracking your activity across third-party apps and websites for advertising purposes.

- You may choose to allow or deny tracking when prompted within the Application.
- If you deny tracking, your experience within the Application will not be affected.
- You may change your tracking preference at any time through your device's Privacy settings under "Tracking."
- Awahe Inc. does not use tracking data for any purpose beyond what is disclosed in our Privacy Policy.

35. Events Listings

35.1 The Awahe Application includes an Events feature that displays local public events across categories, including Religious, Concerts, and Sports. Event listings may be submitted by third parties or sourced from public event data and are not organized or hosted by Awahe Inc.

35.2 Event listings displayed in the Application are manually sourced and curated by the Awahe team from publicly available information and direct organizer contact. While we make reasonable efforts to ensure accuracy, event details, including dates, times, and locations, may change without notice. Users are solely responsible for independently verifying event details before attending.

35.3 Awahe Inc. reserves the right to remove any event listing at any time without notice if it violates these Terms or applicable law.

35.4 Awahe Inc. shall not be liable for any loss, inconvenience, or damage arising from a User's reliance on event information displayed in the Application.

36. Video and Media Content

36.1 Prior to appearing in any video content published on the Platform, all Awahe team members and employees provide written consent authorizing Awahe Inc. to record, publish, and distribute their image and voice for educational and promotional purposes.

36.2 All video content is owned by or licensed to Awahe Inc. and is protected by applicable intellectual property laws. You may not download, reproduce, share, or redistribute any video content from the Application without prior written consent from Awahe Inc.

36.3 Awahe Inc. reserves the right to add, remove, or modify video content at any time without notice.

36.4 User video upload functionality may be introduced in a future version of the Application, at which point these Terms will be updated accordingly.

37. In-App Support

37.1 The Awahe Application includes an in-app support feature that allows Users to contact the Awahe support team directly by phone. Support is available 7 days a week between 7:00 AM and 7:00 PM Pacific Time at (209) 310-0333.

37.2 Awahe Inc. does not guarantee specific response times or resolution outcomes. Support is provided on a best-efforts basis and is subject to staff availability during published support hours.

37.3 Phone calls to the support line may be recorded or logged for quality assurance and training purposes. By calling our support line, you consent to such recording or logging where permitted by applicable law.

38. Free Demo Class

38.1 Awahe offers a complimentary free demo class to prospective students. The demo class is a live 45–60 minute session delivered via Google Meet, available Monday to Saturday between 6:00 AM and 10:00 PM.

38.2 Registration for the free demo class requires you to provide your name, email address, and password to create an Account. By registering, you agree to these Terms and our Privacy Policy.

38.3 The free demo class is provided at no cost and with no obligation to enroll in a paid course. Awahe Inc. reserves the right to modify, reschedule, or cancel demo sessions at any time without prior notice.

38.4 Following the demo class, our team may contact you with course recommendations and enrollment information. You may opt out of such communications at any time by contacting info@awahe.com.

39. Klarna Financing

39.1 Awahe offers financing options through Klarna (Klarna Bank AB) on eligible course purchases made through the Website. Klarna's "Pay Later" and installment payment options allow eligible users to spread the cost of their purchase over time.

39.2 Klarna financing is provided by Klarna Bank AB and is subject to Klarna's own terms and conditions, privacy policy, and credit assessment process. By selecting Klarna as a payment option, you agree to Klarna's terms available at klarna.com/us/legal.

39.3 Awahe Inc. is not a lender and is not responsible for Klarna's credit decisions, financing terms, interest rates, or fees. All disputes regarding Klarna financing must be directed to Klarna directly.

39.4 Klarna financing is available for Website purchases only. Klarna is not available for purchases made through the Apple App Store or Google Play Store, which are subject to those platforms' own billing systems.

40. Children's Privacy and COPPA Compliance

Awahe Inc. is committed to complying with the Children's Online Privacy Protection Act (COPPA) and applicable international children's privacy laws.

40.1 The Application is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13 without verifiable parental consent.

40.2 If a parent or guardian becomes aware that their child has provided personal information without consent, they should contact us immediately at info@awahe.com. We will take steps to remove such information within 30 days.

40.3 Where the Application is accessible to users aged 13-17, we limit data collection to what is strictly necessary and treat all such data as Sensitive Personal Information (SPI) under applicable law.

40.4 We do not serve behaviorally targeted advertisements to users under the age of 16.

40.5 Parents or legal guardians may request access to, correction of, or deletion of their child's personal data by contacting us at info@awahe.com.

41. Accessibility

Awahe Inc. is committed to making the Application accessible to all users, including those with disabilities.

41.1 The Application is designed to support standard accessibility features available on iOS and Android devices, including but not limited to screen readers (VoiceOver, TalkBack), dynamic text sizing, and display color adjustments.

41.2 If you experience any accessibility issues while using the Application, please contact us at info@awahe.com so we can work to address them.

41.3 Awahe Inc. aims to comply with applicable accessibility standards, including the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, where technically feasible.

42. Export Compliance

The Application may be subject to U.S. export control laws and regulations. By downloading or using the Application, you represent and warrant that:

- You are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist-supporting" country;
- You are not listed on any U.S. Government list of prohibited or restricted parties, including the Specially Designated Nationals list maintained by the U.S. Treasury Department.

You agree to comply with all applicable export control laws and regulations in connection with your use of the Application.
